Terms of Service

Effective July 28, 2026. These Terms of Service govern your access to and use of Hyphen. Please read them carefully.

1. Who We Are

Hyphen (“Hyphen”, “we”, “us”) is an AI API gateway based in Malaysia. These Terms of Service constitute a binding agreement between you and Hyphen. Inquiries may be directed to support@hyphen-solution.com.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, and you must have the legal capacity to enter a binding contract. The Service is not intended for children and we do not knowingly provide it to them.

You may not use the Service if any law that applies to you bars you from doing so, including sanctions, embargo, and export-control law. If you accept these Terms for a company or other organisation, you confirm you are authorised to bind it, and “you” means that organisation.

3. The Service

Hyphen provides access to third-party AI language models through a single industry-standard API endpoint, offered at a flat recurring price or through prepaid credit. Each plan carries a monthly usage allowance enforced as a hard cap: once a key's allowance is exhausted, further requests are declined with an HTTP 429 response until the allowance resets at the start of the next monthly cycle. Allowances reset monthly on both monthly and yearly plans; yearly plans spread an annual allowance evenly across the months of the term, so each month's allowance is 10/12 of the corresponding monthly plan's, and unused allowance does not roll over. We do not bill for overage under any circumstances; declined requests are the sole enforcement mechanism, and your charges will not exceed the price you agreed to pay.

Model identifiers in the catalog are the real names of the underlying provider models (for example, minimax-m3 by MiniMax), not proprietary aliases. The catalog may change over time as models are added, upgraded, or retired; we will give notice of material catalog changes. During a provider incident, a request may be served by a smaller model of the same family as a temporary fallback; when this happens, the API response identifies the model that actually served the request.

4. Availability and an Evolving Service

We run the service on a best-effort basis. These plans do not include an uptime guarantee or a service-level agreement, and they do not include a guaranteed support response time. Availability also depends on upstream model providers we do not control. We may perform maintenance, and we will try to schedule anything disruptive outside peak hours.

Hyphen is a new product and it is still changing. Features, endpoints, models, limits, and console behaviour may change, and features may be withdrawn. Where a change would materially reduce what you get during a period you have already paid for, we will give notice. Anything labelled beta or preview is offered as it is, may be unstable, and may be removed at any time.

5. Your Account

An account is required to use the Service. You must provide accurate information, keep it current, and keep your credentials secure. You are responsible for all activity that occurs under your account. One person or organisation per account; do not create accounts to work around a cap, a limit, a price, or a suspension.

6. API Keys and Security

Your API keys are secrets. Treat them the way you treat passwords. Do not commit them to public repositories, embed them in client-side code or in a mobile app, or post them anywhere they can be read.

You are responsible for all usage under your keys, including usage by anyone you share a key with and usage you did not intend. It counts against your allowance either way. If you give a key to a teammate, a contractor, or an agent you built, their use is your use.

Tell us at support@hyphen-solution.com as soon as you believe a key has leaked or that someone has accessed your account without permission. We will rotate it. We may also rotate or disable a key ourselves if we find it exposed in public or see it being used abusively.

7. Fair Use and Rate Limits

Alongside your monthly allowance, use of the Service is subject to fair-use rate limits. These may include a ceiling on requests and tokens per unit of time and a ceiling on how many requests you can have in flight at once, and they scale with your plan. When you cross one, requests are declined with an HTTP 429 and you can retry.

We tune these limits operationally to keep the Service stable and to stop one customer's traffic from degrading everyone else's. We will not use them to quietly withhold the allowance you paid for. If your workload needs a higher limit, ask us.

8. Acceptable Use

You agree not to:

  • use the service to generate or distribute illegal content, or otherwise break the law;
  • abuse or resell the upstream model capacity we provision (Hyphen is for your own applications and agents, not for operating a competing resale gateway);
  • attempt to bypass usage caps, rate limits, or any other technical enforcement;
  • share keys at scale — a key is for you or your team, not for public or bulk distribution;
  • interfere with the operation or security of the service.

9. Your Content and Your Use of Output

You keep what is yours. As between you and Hyphen, you own the content you send to the Service, and you own the output generated for you to the extent it can be owned under the law that applies to you. We claim no ownership of either, and we do not train models on your content. What we log is set out in the Privacy Policy.

You are responsible for what you send and for what you do with what comes back. AI output can be wrong, out of date, biased, offensive, or unsuitable for your purpose, and the same request can return different answers on different days. Review output before you rely on it, publish it, ship it, or act on it. You are responsible for checking that your use of output complies with the law and with anyone else's rights.

Do not send content you do not have the rights to send. Do not send personal data or sensitive data you are not entitled to process. If you do send personal data, you are the controller of it and you are responsible for having a lawful basis, for telling the people concerned, and for honouring their rights. Contact us before you start if your use needs a data processing agreement.

10. No High-Risk Use

The Service is a general-purpose developer tool. It is not built, tested, or certified for high-stakes decisions. Do not use it as the basis for medical, legal, financial, insurance, employment, housing, credit, immigration, or similar decisions about a person without qualified human review by someone competent to make that decision.

Do not use the Service in any setting where a failure, a delay, or a wrong answer could lead to injury, death, or serious harm to people, property, or the environment. That includes safety-critical control systems, medical devices, emergency response, transport, and industrial control. If you use the Service in these areas anyway, you do so at your own risk and you are responsible for the outcome.

11. Upstream Model Providers

Your requests are served by third-party model providers. Their acceptable-use and content policies apply to your usage in addition to ours, and by calling a model you agree to follow the policies of the provider behind it. Where a provider's policy or the law requires it, we may pass on information about suspected abuse.

Upstream providers receive the content needed to serve each request and may cache or retain it under their own terms and privacy policies. Do not send secrets, highly sensitive personal data, or content you are not permitted to disclose. Our Privacy Policy explains the current providers and data flow.

We do not control those providers. The catalog, the models in it, and the providers behind them may change. A provider may change its prices, change its policies, restrict a model, degrade, or go down without warning. Those events are outside our reasonable control and are not a breach of these Terms by us. Section 3 explains how we handle catalog changes and temporary fallbacks.

12. Subscriptions and Billing

Subscriptions are billed through Stripe and renew automatically each month or year until cancelled. Checkout displays the renewal terms and asks you to confirm the Terms before payment. You can manage or cancel from Billing in the console without contacting support; cancellation takes effect at the end of the current billing period, and you keep your allowance until then. Prices may change, but never mid-period — any change applies from your next renewal, with notice.

13. Credits

Credit packs are one-time prepaid purchases that fund a separate pay-as-you-go API key. Credits do not expire, and their balance does not reset. Credits are not legal tender, carry no cash value, and are non-refundable except where a refund is required by applicable law. The credit amount granted for each pack is fixed at checkout.

14. Payments Are Final

All payments — subscriptions and credit packs alike — are final and non-refundable, except where a refund is required by applicable law. Subscriptions can be cancelled at any time and remain active until the end of the paid period; prepaid credits never expire. If you believe you were charged in error, contact support@hyphen-solution.com and we will investigate.

15. Suspension

We may suspend, rate-limit, or restrict your account, your keys, or particular requests immediately and without prior notice. We will tell you what happened and what to do about it as soon as it is practical, and we lift a suspension once its cause is resolved. A suspension does not pause or extend your billing period, and a suspension for cause is not by itself a ground for a refund.

We may act where we reasonably believe there is:

  • abuse, fraud, or a chargeback or failed payment on your account;
  • a security risk to the Service, to your data, or to other customers;
  • unlawful use, or use that breaks these Terms or an upstream provider's policies;
  • a traffic pattern that threatens the stability of the Service or the capacity we provision for everyone else;
  • a legal or regulatory requirement that we act.

16. Termination

You can stop using the service and cancel at any time. We may suspend or terminate accounts that violate these terms — including the acceptable-use rules above — with immediate effect for serious abuse. Where practical we will warn you first. On termination, your keys stop working; sections that by their nature survive (such as liability limits) continue to apply.

Sections that survive termination include your content and output responsibilities, the indemnity, the disclaimers and liability limits, and the general and governing-law sections. Unused allowance and unused credits are not refunded on termination, except where a refund is required by applicable law.

17. Indemnity

You agree to defend Hyphen against any third-party claim that arises from your use of the Service, from the content you send or publish, or from your breach of these Terms or of an upstream provider's policies, and to cover the reasonable losses, damages, settlements, and legal costs we incur because of it.

This is meant to be fair, so it works in both directions. We will tell you about a claim promptly, give you reasonable control of the defence, and cooperate with you at your expense. We will not settle a claim in a way that admits fault on your behalf or imposes an obligation on you without your consent. This section does not apply to the extent the claim is caused by our own breach or negligence, or to anything we cannot lawfully ask you to cover.

18. Disclaimers and Limitation of Liability

The service is provided “as is” and “as available”, without warranties of any kind, express or implied. To the extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from a course of dealing. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that model output will be accurate, complete, or fit for your purpose. AI model output can be wrong; you are responsible for how you use it.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service is limited to the fees you paid to Hyphen in the three months before the event giving rise to the claim.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost or corrupted data, loss of goodwill or reputation, business interruption, wasted expenditure, or the cost of substitute services. Nor are we liable for the acts, omissions, outages, price changes, policy changes, or content decisions of upstream model providers, or for anything you or your users do with model output.

Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be excluded or limited. If you are a consumer with mandatory statutory rights, those rights are unaffected and apply in addition to these Terms. Where a limitation in this section is not permitted by the law that applies to you, it is limited to the least extent that law permits rather than removed.

19. Changes to These Terms

We may update these terms as the product evolves. For material changes we will give notice — by email or a prominent notice on the site — before the change takes effect. Continuing to use the service after the effective date of an update means you accept the updated terms. If you do not accept them, cancel before they take effect.

20. How You Accept These Terms

You accept these Terms by ticking the acceptance box when you create your account. When you tick it we store a record of that acceptance: the time you accepted, the version of these Terms you accepted, and the technical details described in the Privacy Policy. That record is our evidence of the agreement between us.

When we publish a material update we may ask you to accept it again in the console. Otherwise, notice under section 19 plus your continued use of the Service after the update takes effect is your acceptance of it.

21. General

Force majeure. Neither party is liable for a failure or delay caused by something outside its reasonable control, including network and internet failures, upstream provider outages, power failures, natural disasters, epidemics, war, civil unrest, strikes, changes in law, and acts of government. This does not excuse an obligation to pay money already owed.

Assignment. You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms to a successor in connection with a merger, an acquisition, a reorganisation, or a sale of all or substantially all of the business, and we will tell you if we do.

Severability. If a court finds any part of these Terms unenforceable, that part is narrowed to the minimum extent needed to make it enforceable, or removed if it cannot be narrowed, and the rest stays in force.

No waiver. If we do not enforce a right or a provision straight away, that is not a waiver of it. A waiver counts only if we give it in writing.

Entire agreement. These Terms, together with the Privacy Policy and the plan details shown at checkout, are the whole agreement between you and Hyphen about the Service, and they replace any earlier understanding about it.

No third-party rights. These Terms do not create rights for anyone who is not a party to them.

Notices. We give notice by email to the address on your account, or by a prominent notice in the console or on the site. Email notice is effective when we send it, so keep your account address current and monitored. Send notices to us at support@hyphen-solution.com.

22. Governing Law and Dispute Resolution

Before initiating formal proceedings, the parties agree to attempt to resolve any dispute informally by contacting support@hyphen-solution.com; most matters can be resolved this way.

These Terms are governed by and construed in accordance with the laws of Malaysia, and any dispute arising out of or relating to these Terms or the Service is subject to the jurisdiction of the courts of Malaysia. If you are a consumer in a jurisdiction whose laws grant you mandatory rights or protections, nothing in these Terms limits or excludes those rights, which apply notwithstanding the foregoing choice of law and forum.
